Either way, they're already "imprisoned" for ~9 months in the womb - does it really matter whether the mother is imprisoned?
Of course, that assumes that mom gets all required medical care in prison, which seems to not be the case here, so either way something needs to change.

Headline is misleading. This isn’t a scenario where they let the thief skate because of some “cruel and unusual” stipulation. The cop didn’t follow legal protocol for a number of other reasons, so the ag didn’t have enough credible evidence to move forward

Let's be specific to the topic of this post. If a pregnant mother is jailed and her fetus is considered to be a living person. Does the fetus deserve to be locked up if it didn't commit any crimes?

Is it a crime to eat good you find on the street? Is it a crime to eat something someone drops?
They should be pursued in order of importance, because it all costs time and money. Detaining someone takes the officers off the streets. Paperwork. Space in the cell becomes occupied. All of that...for a bag of chips. I'm sure the shop didn't even press charges because of it, but they too had to waste time to react. This is incompetence. Stealing is a crime, but not every theft requires the full process.
